Nnamdi Kanu Accuses Justice Nyako of Bias: A Heated Courtroom Clash

On Monday, Nnamdi Kanu, the imprisoned leader of the indigenous People of Biafra (IPOB), launched a stunning defense against Nigeria's prosecution and Chief Judge of the Federal High Court, Abuja, claiming that Justice Binta Nyako must try him even though she had been ordered to recuse herself from the case.

Kanu became enraged during his court appearance and criticized Justice Nyako for insisting on hearing his case. He claimed that she is extremely biased, mingles with attorneys and justices, and that it is dishonorable to insist on trying him against the court's ruling.

The head of IPOB went on to say that the prosecution lawyer "is acting like a child because he is receiving N300 million from the office of the Attorney General of the Federation and Minister of Justice (AGF)."

"I have a court order," declared the furious IPOB leader. You've withdrawn. You always inform me that anyone who disagrees with this court order should go to the appeal court.

"They've recused you. No matter how much time passes, you will never be able to preside over this case number again.

"Not today, not till forever," he continued, adding that the prosecution could not compel the court to hear his case. Both you and your position are recused.

"Tell the Chief Judge, Nnamdi Kanu said, go on appeal," he added. You are no longer involved in my case. Why must you insist on hearing my case when the state recused Justice Adema from it and did not demand that she do so?

"I don't want you to listen to my argument. You are not necessary in my situation. You're biased. You are not in my situation.

"You cannot be mingling with attorneys and justices when you are in the middle of a lawsuit. It's embarrassing, really embarrassing.

"This isn't a legal court. I refuse to be subjected to this shrine to injustice. You have to abandon my case as you are recused. I'm not yours to try.

For heaven's sake, she is a Senior Advocate, and there is a recusal order. The rule of law, isn't it? According to the law, you can file an appeal if you disagree with this.

Kanu also blasted the prosecution, saying, "You are an adult. You are acting like a child because of N300 million. Make an appeal. You are standing here defending evil because they are paying you money from the AGF's office.

"An adult such as yourself. Act like a man of integrity. According to the law, you ought to file an appeal. My case cannot be tried by His Lordship Justice Binta Nyako on this world. Stop wasting your time since I'm telling you that now.

"According to a court order, Justice Binta Nyako is recused," he continued. I recused the Chief Justice who is composing the foolish memo. A functus officio, he was.

On appeal, he sat. I recused him after taking him to NJC. Why didn't he state that he had to oversee my case? Why is he insisting in His Lordship's case? By asking her to come and sit on this case, he hopes to make her feel embarrassed.

"If you insult yourself, I will insult you," he responded in response to the prosecution's warning that it was improper to make fun of a judge. You guys are breaking the law, so I will insult you if you don't respect yourselves.You completely upend the law when it comes to Nnamdi Kanu. You people claim that this paper is black, even though the law states that it is white.

Is that a law? Is that law, as the Senior Advocate of Nigeria? Is the Chief Judge's memo enough to overturn the court order? Why would you like to alter the law in my situation?

"His Lordship Justice Binta Nyako is unable to try me since she is recused from the matter. Shameless people.

According to a memo from a High Court Chief Judge, National Judicial Policy of Nigeria IC states that "the judge is subject only to the law and must only consider the law in the performance of judicial functions."
