US Supreme Court Allows Trump’s Ban On Trans Troops To Take Effect
A divided US Supreme Court on Tuesday allowed President Donald Trump’s ban on transgender military personnel to take effect while litigation plays out, putting thousands of troops at risk of dismissal.

The decision, which was opposed by the court's three liberal justices, is a major win for Trump, who has attacked judges who have obstructed portions of his agenda and has made reversing transgender rights a central component of his second term in office.

The Human Rights Campaign Foundation and Lambda Legal, the firms who brought the case that led to a lower court temporarily halting the ban's execution, blasted the Supreme Court's ruling.

The organizations said in a statement that the decision "is a devastating blow to transgender servicemembers who have demonstrated their capabilities and commitment to our nation's defense."

“Transgender individuals meet the same standards and demonstrate the same values as all who serve.

We are adamant that this prohibition will be overturned since it breaches equal protection clauses in the constitution," they stated.

Trump and Pentagon commander Pete Hegseth "are restoring a military that is focused on readiness and lethality — not DEI or woke gender ideology," according to White House Press Secretary Karoline Leavitt, who praised the decision as "another MASSIVE victory in the Supreme Court" in a post on X.

"No More Trans @ DoD" was Hegseth's response to the news, which he posted on his personal X account.

In a January 27 executive order, Trump wrote that “expressing a false ‘gender identity’ divergent from an individual’s sex cannot satisfy the rigorous standards necessary for military service.”

Shifting policies

The Pentagon responded in late February with a memo saying that it would not allow transgender individuals to enlist and would remove transgender troops from the military unless they were granted a dispensation on an individual basis.

Due to the Supreme Court's ruling permitting the prohibition to go into effect, thousands of troops who are presently serving may be dismissed.


According to a senior defense official, there were 4,240 military personnel with a diagnosis of gender dysphoria as of late last year. The restrictions in the Pentagon letter target people who have been diagnosed with the disorder, have a history of it, or show symptoms of it.

In recent years, transgender Americans have experienced a whirlwind of shifting military service regulations, with Trump trying to keep them out of the ranks and Democratic administrations trying to allow them to serve openly.

In 2016, during the second term of Democratic President Barack Obama, the United States military abolished its prohibition on transgender troops.

Transgender recruits were to begin being welcomed by July 1, 2017, and trans troops who were already serving were allowed to do so publicly.

However, the first Trump administration decided to completely repeal the regulation after delaying that date until 2018.

After a lengthy legal struggle that reached the country's highest court, Trump's limits on transgender military service, which had been modified in response to many legal challenges, finally went into effect in April 2019.

Days after taking office in 2021, his Democratic replacement Joe Biden took steps to lift the restrictions, but Trump was reelected last year after announcing that he would once more aim to restrict transgender rights.

Since states ruled by Democrats and Republicans have taken opposing stances on subjects ranging from medical care to which publications on the subject are permitted in public or school libraries, transgender issues have become a contentious issue in US politics.
